Regulations on intra-party accountability of the communist party of China

Article 1 these regulations are formulated in accordance with the constitution of the communist party of China in order to uphold party leadership, strengthen party building, comprehensively enforce strict party governance, ensure the implementation of the party's line, principles and policies and the major decisions and arrangements of the CPC Central Committee, and standardize and strengthen the party's accountability work.

Article 3 the party's accountability work shall adhere to the following principles:

(1) to seek truth from facts in accordance with regulations and disciplines;

(2) those who fail to perform their duties shall be held accountable and held strictly;

(3) equal rights and responsibilities, and equal wrong and liability;

(4) combine strict control with great love, attach equal importance to encouragement and restraint;

(5) learn from past mistakes to avoid future ones and cure diseases to save others;

(6) to make collective decisions and distinguish responsibilities.

Article 4 the party committee (leading group) shall perform its principal responsibility for comprehensively governing the party with strict discipline, strengthen its leadership over the accountability work of its own departments and units in the region, and investigate the principal responsibility, supervisory responsibility and leadership responsibility of party organizations and leading cadres for dereliction of their responsibilities in party building and the cause of the party.

The commission for discipline inspection shall perform its special task of supervision and assist the party committees at the same level in carrying out their accountability work. The institutions accredited or dispatched by the commission for discipline inspection shall carry out accountability work according to their functions and powers.

Party organs shall perform their supervisory duties according to their functions and carry out their own accountability work within their own systems and in their own fields.

Article 5 party organizations and leading party cadres shall be held accountable, with emphasis on the party committee (leading party group), party organs and their leading members, and the commission for discipline inspection, its accredited (dispatched) institutions and their leading members.

Article 6 responsibility shall be distinguished from responsibility. The leading group of the party organization has the overall leadership responsibility within the scope of its responsibilities, the leading group members who are mainly in charge and directly in charge assume the main leadership responsibility within the scope of their responsibilities, and the leading group members who participate in decision-making and work assume the important leadership responsibility within the scope of their responsibilities.

If party organizations are held accountable, they shall also be held accountable to the leading members of the party organizations who are responsible.

Party organizations and leading party cadres should persist in assigning responsibility to themselves, their duties and their work, focus on identifying problems and investigating causes within themselves, be brave enough to assume responsibility and be responsible, and refrain from shirking responsibility to lower-level party organizations and cadres.

Article 7. Party organizations and leading cadres who violate the party constitution and other intra-party laws and regulations and fail to perform or incorrectly perform their duties shall be held accountable for any of the following:

(a) the leadership of the party weakened, four consciousness is not strong, the lack of "two maintenance", the party's basic theory, basic line, basic strategy has not been effectively carried out, in carrying out the new development concept, promote the economic construction, political construction, cultural construction, social construction, the construction of ecological civilization, significant deviation and error, causing serious losses to the party's cause and the interests of the people, the bad influence;

(7) lax efforts to improve party conduct, build an honest and clean government, and fight corruption; weak efforts to reduce the stock of corruption cases and curb the growth of corruption cases, especially those involving corruption cases that have not been consolidated or stopped, that have received concentrated and strong responses from the public, and that have had mixed political and economic problems;

Other cases of dereliction of duty for which accountability is due.

Article 8 party organizations may be held accountable in the following ways according to the degree of harm and the specific circumstances:

(1) inspection. Order to make written inspection and practical rectification.

(3) reorganization. Those who are derelict in their duty, seriously violate party discipline and are unable to rectify themselves, shall be reorganized.

In light of the degree of harm done and the specific circumstances, the following measures may be taken to hold leading party cadres accountable:

(ii) admonition. Admonish in conversation or writing.

(3) organizational adjustment or organizational treatment. (4) disciplinary actions. If the dereliction of duty or the damage is serious and disciplinary action should be taken, the disciplinary responsibility shall be investigated in accordance with the regulations of the communist party of China on disciplinary actions.

The above accountability methods may be used separately or in combination according to the regulations. If the mode of accountability has an impact period, it shall be implemented in accordance with relevant provisions.

Article 9 where an accountability investigation is necessary due to any of the circumstances listed in article 7 of these regulations, the party committee (leading party group), the commission for discipline inspection or the working organ of the party that has the authority to administer the investigation shall, upon the examination and approval of the principal responsible person, launch the accountability investigation procedure in a timely manner. Among them, the commission for discipline inspection and the working organs of the party should report to the party organization directly under the leadership of the party committee at the same level and its principal heads for approval if they initiate an accountability investigation.

If an accountability investigation is not launched in time, the party organization at a higher level shall order the party organization with administrative authority to start the investigation. Depending on the nature of the problem or the needs of the work, the higher party organization may directly initiate the accountability investigation or designate other party organizations to initiate the investigation.

If party organizations and leading party cadres are held accountable for their actions under investigation, the procedure of accountability investigation shall not be initiated.

Article 11 after ascertaining the problem of the investigated object's dereliction of duty, the investigation team shall write factual materials, meet with the investigated object, listen to its statement and argument, and put it on record. Reasonable opinions should be adopted. The object of the investigation shall sign the opinions on the factual materials, and the investigation team shall give explanations or indicate the situation if it signs the different opinions or refuses to sign the opinions.

Upon completion of the investigation, the investigation team shall conduct a collective discussion to form an investigation report, which shall set out the basic situation, basis and process of the investigation, the facts of accountability, the attitude, understanding, defense, handling opinions and basis of the investigation objects, and shall go through the examination and approval procedures after being signed by the leader of the investigation team and relevant personnel.

Article 12 decisions on accountability shall be made by party organizations with administrative authority.

With respect to party organizations directly under the leadership of the party committee at the corresponding level, the commission for discipline inspection and the working organs of the party may, upon approval of the party committee at the corresponding level or its principal person-in-charge, conduct inspections or circulars to hold them accountable. Those who are held accountable by means of reorganization shall follow the limits of authority and procedures prescribed in the party constitution and relevant intra-party laws and regulations.

Leading cadres under the management of the party committee at the corresponding level, and the commission for discipline inspection and working organs of the party may, with the approval of the party committee at the corresponding level or its principal person-in-charge, circulate and admonish them to perform their duties. Propose organizational adjustment or organizational treatment. Those who take disciplinary measures for accountability shall follow the limits of authority and procedures prescribed in the party constitution and relevant intra-party laws and regulations.

Article 13 after a decision on accountability is made, it shall be promptly announced to the party organization being held accountable, the leading cadres being held accountable and the party organization to which they belong and shall be urged to carry out the decision. The commission for discipline inspection and the departments for discipline inspection shall file the materials of the decision on accountability into the files of the leading cadres who are held accountable for corruption. The departments for discipline inspection shall file the materials on the personnel files of the leading cadres who are held accountable for corruption and report them to the departments at the next higher level for archival filing. In case of organizational adjustment or handling, the corresponding procedures shall be completed within 1 month.

A leading cadre who is held accountable shall write a written review to the party organization that made the decision on accountability and make a thorough examination at the democratic or organizational meetings or at other party meetings. The system of reporting and exposing typical problems of accountability shall be established and improved, and the accountability shall be made public in an appropriate way if organizational adjustment or organizational treatment or disciplinary action is taken.

Article 14 the party organizations to be held accountable, the leading cadres to be held accountable and the party organizations to which they belong shall draw lessons from their mistakes and specify corrective measures. Party organizations that make accountability decisions should strengthen supervision and inspection and promote reform through cases.

Article 15 if it is necessary to take administrative measures or other actions against the party to be held accountable, the party organization that made the decision on accountability shall notify the relevant units, and the relevant units shall promptly handle the matter and report the result to the party organization that made the decision on accountability.

Article 16 lifelong accountability shall be exercised. If dereliction of duty is of a bad nature and the consequences are serious, the person responsible shall be held seriously accountable, regardless of whether he or she has been transferred or transferred to another post, promoted or retired.

Article 17 in any of the following circumstances, accountability may be exempted or exempted:

(1) the mistakes in promoting reform due to lack of experience and trial and error, as well as the mistakes in exploratory experiments without clear limits, are inadvertent mistakes in promoting development;

(2) express opposition or reservation to the wrong decision in the collective decision;

(3) party b has performed its duties in the implementation of the decision, but causes losses due to force majeure, unforeseeable or other factors.

If the opinions on correcting or cancelating the wrong decision made by the superior are not accepted, and the situation of accountability listed in article 7 of these regulations occurs, the provisions of the preceding paragraph shall be dealt with. If the wrong decision made by the superior is obviously illegal or illegal, it shall bear corresponding responsibilities.

Article 18 under any of the following circumstances, accountability may be mitigated or mitigated:

(1) taking timely remedial measures to effectively recover losses or eliminate adverse effects;

(2) actively cooperating with the accountability investigation and taking the initiative to assume responsibility;

(3) other circumstances of lightening the burden or alleviating the burden as stipulated by party regulations.

Article 19 in any of the following cases, the accountability shall be increased or increased:

(1) failing to carry out or failing to carry out the repeated instructions and requirements of the party central committee and the party organizations at higher levels;

(2) failing to truthfully report the situation, performing perfunctory and shirking responsibilities, or abetting or acquiescing in the falsification of relevant departments and personnel, thereby obstructing the work of accountability;

(3) other circumstances of being heavier or more serious as stipulated by party regulations.

Article 20 if an object of accountability disagrees with the decision on accountability, it may, within one month from the date of receiving the decision, submit a written appeal to the party organization that made the decision. After receiving the written appeal, the party organization that made the decision shall make a decision on handling the appeal within one month and inform the party organization, leading cadre and the party organization to which the appeal is made in writing.

The enforcement of the accountability decision shall not be suspended during the appeal period.

Article 21 if, after making the accountability decision, it is found that the ascertaining of the accountability facts is unclear, the evidence is not conclusive, the basis is not sufficient, the responsibility is not clear, the procedures are not in compliance, the handling is not appropriate, or there are other situations where accountability should not be held accountable or inaccurate, it shall be rectified in a timely manner. When necessary, the party organization at a higher level may directly correct it or order the party organization that made the decision to correct it.

Party organizations and leading party cadres who abuse accountability or are grossly irresponsible in their work and cause adverse effects shall be held accountable.

Article 22 cadres who are held accountable shall be treated correctly, and cadres whose influence has expired and whose performance has been good, and who meet the requirements, shall be used normally in accordance with the relevant provisions on selection and appointment of cadres.

Article 23 the authority of examination and approval involved in these regulations refers to the lowest authority of examination and approval.

Article 24 in addition to implementing this article, the institutions accredited or dispatched by the commission for discipline inspection shall also implement the relevant provisions of the CPC Central Committee and the commission for discipline inspection of the CPC Central Committee.

Article 25 the central military commission may formulate relevant provisions in accordance with these regulations.

Article 26 the interpretation of these regulations shall be vested in the central commission for discipline inspection.

Article 27 these regulations shall take effect as of September 1, 2019. The regulations on the accountability of the CPC issued by the CPC Central Committee on July 8, 2016 shall be repealed at the same time. In case of any inconsistency between the previously issued provisions on accountability and these regulations, these regulations shall apply.
