Regulations on the protection of the rights of CPC members

Chapter I general provisions

Article 1 these regulations are formulated in accordance with the constitution of the communist party of China in order to develop inner-party democracy, improve inner-party life, adhere to the principle of democratic centralism, enhance the vitality of the party, and ensure the normal exercise of the rights of party members and their inviolability.

Article 2 the rights enjoyed by party members as stipulated in the party constitution must be respected and protected, and no party organization at any level or party member has the right to deprive them.

Article 3 everyone is equal in the face of party discipline and no party member is allowed to enjoy privileges.

Article 4 the unity of rights and obligations shall be upheld. A party member shall correctly exercise all the rights prescribed in the party constitution and act within the scope of the constitution and the law.

Article 5 any act that infringes upon the rights of party members shall be investigated. If the circumstances are serious, party discipline must be punished. The identification and handling of violations of party members' rights shall be based on facts and governed by the party constitution and other intra-party laws and regulations.

Chapter ii rights of party members

Article 6 party members shall have the right to attend meetings of party leading groups, general meetings of party branches, general meetings of party members and meetings corresponding to their party posts and qualifications as deputies. Any party member who is unable to attend the meeting for any reason shall go through the leave formalities.

Party members shall have the right to read party documents that are available according to regulations.

Party members have the right to demand education and training. Party members shall be subject to organizational arrangements in receiving education and training.

Article 7 party members shall have the right to participate in the discussion of party policies and theoretical issues at party meetings and to express their views fully.

Party members shall have the right to participate in discussions on party policies and theories organized by the central and local party organizations in party newspapers and periodicals.

In discussing the party's policies and theoretical issues, party members should consciously maintain a high degree of agreement with the central committee of the party, and should not publicly express views or opinions that contradict the party's basic theory, line, program or experience.

Article 8 party members shall have the right to put forward, orally or in writing, Suggestions and proposals on all aspects of the work of their own regions, departments, party organizations of their own units, party organizations at higher levels, and even the central committee.

Article 9. A party member shall have the right, either orally or in writing, to make well-grounded criticisms of any party organization and any party member at party meetings. A party member's written criticism shall, in accordance with the relevant regulations, be submitted to the party being criticized or to the relevant party organization.

A party member shall have the right to expose and report to the party organization, in a responsible manner, any violation of the law or discipline committed by any party organization or party member; The party shall have the right to demand from the party organization to which it belongs or from the party organization at a higher level for the punishment of party members who have committed violations of law and discipline.

A party member shall have the right to request to his or her own party organization or a higher party organization for the removal or removal of an incompetent leading party member or cadre.

When criticizing, exposing and reporting, or making requests for punishment, dismissal or replacement, party members should follow the organizational principles and follow the relevant procedures. They should not spread or disseminate information at will, exaggerate or distort facts, nor fabricate facts or false accusations.

Article 10 party members shall have the right to vote in accordance with the relevant provisions in the discussion and decision of party organizations. Voting may be in favour, disfavour or abstention.

Every full party member has the right to vote and stand for election (except those who have been placed on probation). Party members who take part in the election have the right to know about the candidates, to demand a change of candidates, to reject any one candidate and to elect another.

Party members have the right to be candidates and elected through prescribed procedures.

Article 11 when party organizations discuss and decide on disciplinary measures to be taken against party members or make appraisals, they shall have the right to participate in and defend themselves, and other party members may testify and defend them.

Pleading, testifying and defending must be realistic.

Article 12. If a party member disagrees with a party resolution or policy, he may, on the premise of resolutely carrying it out, make a reservation at a party meeting or to the party organization, and may report his opinion to the higher party organization up to the central committee. Party members shall not publicly express opinions contrary to the decisions of the central committee.

Article 13 a party member who needs the help of the party organization to solve important problems in politics, work or study shall have the right to make a request to the party organization to which he belongs, to the party organization at a higher level or even to the central committee.

If a party member is not satisfied with the punishment, appraisal, examination conclusion or other treatment given him or her by the party organization, he or she shall have the right to appeal to the party organization to which he or she belongs, the party organization at a higher level or even the central committee. If a party member considers that the punishment, appraisal, review or other improper treatment given to another party member by the party organization, he or she shall have the right to submit his or her opinions to the party organization, level by level, and even to the central committee.

If a party member's legitimate rights and interests are infringed upon by a party organization or any other party member, the party member shall have the right to file a complaint with the party organization to which he belongs, the party organization at a higher level, or even the central committee.

Party members have the right to demand responsible responses from the relevant party organizations to their requests, appeals and complaints.

Chapter iii safeguard measures

Article 14 party organizations shall convene relevant meetings in accordance with relevant provisions and create conditions to ensure that party members participate in any meetings to which they are entitled. The organization and convener of the meeting shall timely inform the party members at the meeting of the time and topic of the meeting.

Article 15 party organizations shall provide party members with the necessary conditions for reading relevant party documents. If a party member is unable to read the document directly because of lack of reading ability or other reasons, the party organization shall convey the spirit of the document to the party member in accordance with regulations.

Article 16 party organizations shall take various forms to educate and train party members in a planned way so as to improve their quality.

Article 17 after the convening of a party congress, a conference of deputies, a plenary session of a party committee or any other important meeting, the party organization shall, in accordance with regulations, communicate and circulate the contents and spirit of the meeting to party members.

Resolutions and decisions made by party organizations shall be promptly notified to party members in accordance with regulations.

Article 18 party organizations at lower levels shall, in accordance with the arrangements of party organizations at higher levels, actively organize and guide party members to participate in the discussion of party policies and theoretical issues. Local party organizations and primary organizations shall earnestly organize party members to discuss issues related to the implementation of party policies in their respective regions, departments and units.

Party organizations should support and encourage members to put forward Suggestions and proposals on the work of the party. Party organizations shall carefully listen to and study the Suggestions and proposals of party members and, if reasonable, adopt them. Party members who have contributed significantly to the improvement of their work shall be commended or rewarded for their Suggestions and proposals.

Party organizations should listen carefully to different opinions. Any party member who holds a different opinion may not be subject to discrimination or prosecution as long as he or she resolutely implements the party's resolutions and policies. Party members who hold erroneous views should be assisted and educated.

Article 19 party organizations shall encourage party members to engage in criticism and self-criticism within the party, and support and protect party members in their struggle against all kinds of violations of law and discipline and unhealthy practices. The party organization shall, in accordance with relevant regulations, promptly handle any criticism, exposure, accusation or accusation made by a party member, as well as any request for punishment, dismissal or replacement.

Party organizations should establish and improve a system for protecting the rights and interests of whistle-blowers. The whistleblowing or informants and the contents of the whistleblowing or informants must be kept strictly confidential, and it is strictly forbidden to transfer the whistleblowing or informants' materials to the organizations or persons accused; It is strictly forbidden to discriminate against, create difficulties for, and suppress whistleblowers, informants, and complainants.

Party organizations shall return visits or letters in an appropriate manner to the whistleblowers or informants with the real names of the agency and inform them of the result of handling. Praise or reward shall be given to those who expose or expose serious violations of laws and disciplines that have been verified through investigation.

Party organizations shall give criticism and education to those who, without responsibility, expose, expose, accuse or demand for punishment, dismissal or replacement; Those who fabricate facts or falsely accuse or frame others shall be dealt with seriously according to the discipline and law. Any party member wrongly accused or falsely accused shall clarify the facts and make an announcement within a certain scope.

Article 20 in discussing and deciding on an issue, party organizations must implement the principle that the minority is subordinate to the majority. Important issues are decided by a vote. According to different circumstances, the vote may be taken orally, by a show of hands, by a vote, etc. The result and manner of voting shall be recorded. Keep a truthful record of different opinions.

Important issues mainly refer to: matters relating to the party's line, principles and policies; Deployment of major tasks; Recommendation, appointment and removal, transfer, rewards and punishments of cadres that should be decided by collective discussion according to the regulations on management of cadres; Issues concerning the immediate interests of the people in production and livelihood; Recruit new party members; Other issues that shall be decided upon through collective discussion as stipulated by party organizations at higher levels.

Before making an important resolution or decision, the party organization shall, in an appropriate manner, consult party members within a certain scope for their opinions. If the majority of party members have different opinions or major differences, a decision shall be postponed, further investigation and study conducted, opinions exchanged and submitted to the next meeting for a vote.

The party committee, its organizational department and the party's commission for discipline inspection shall supervise and inspect the voting of party organizations at lower levels, and shall correct any failure to vote in accordance with regulations.

Article 21 in conducting elections, party organizations shall give full expression to the will of the electors. The election is by secret ballot. The list of candidates shall be fully deliberated and discussed by party organizations and electors, and information about the candidates shall be presented to electors. You can vote yes, no or no to a candidate. A dissenter may elect another.

Any party organization or any party shall not, in any way hinder party members in the party independently exercise the right to vote and be elected, shall obstruct people have the right to vote and be elected, shall not force the electoral vote or not one person may not organize activities do not interfere with the election, in any way to pursue the electoral vote.

Article 22 the facts on which the party organization bases its decision on a disciplinary action against a party member and its decision on the disciplinary action must be presented to the party member to hear his explanation and argument. Party organizations concerned shall carefully listen to and truthfully record the arguments made by party members and the testimonies and justifications made by other party members on their behalf, further verify them and adopt their reasonable opinions; Do not accept, to explain to oneself reason. A party member's fact-based defense, testimony and defense shall be protected.

The decision on punishment shall specify the right of appeal enjoyed by the party member and the organization accepting the appeal, and shall be signed by the party member under punishment. If he has different opinions on the decision of punishment, he may appeal; If the party refuses to sign the opinion or cannot sign the opinion for other reasons, the party organization shall indicate on the decision on the sanction.

Article 23 party organizations shall help party members who are punished by party discipline to correctly understand and correct their mistakes. If a party member who has been placed on probation within the party has indeed rectified his or her mistakes during the period of such probation, his or her rights as a party member shall be restored at the expiration of the period. Those who persist in making mistakes or find other mistakes that should be punished by party discipline should be expelled from the party.

Article 24 party organizations shall deal seriously with complaints from party members. The party organization concerned shall, in accordance with relevant regulations, review and review the appeal of a party member and shall not withhold it. Party organizations at higher levels may, when they deem it necessary, directly or designate party organizations concerned to conduct reconsideration or review.

After reconsideration, review or decision, the new decision shall be announced within a certain scope in the case where all or part of the correction has been made. To deal with the correct and I refuse to accept the criticism of education; In case of repeated appeal without justified reasons, the relevant party organization shall officially inform the party itself that it will no longer accept the appeal and announce it within an appropriate scope.

The relevant party organizations shall carefully study and deal with the opinions of party members on the punishment, appraisal, examination conclusion or other treatment given to other party members by party organizations.

Article 25 party organizations must be resolute and prudent in their examination and handling of party members suspected of violating discipline, strictly abide by relevant regulations, and comply with discipline and law.

Establish a system of accountability for wrongdoing or misjudged cases. Those who have committed disciplinary violations or other faults in the course of enforcing discipline shall be criticized and corrected; If the circumstances are serious, the person responsible shall be investigated for responsibility.

Article 26 party organizations shall promptly accept requests made by party members. According to specific problems, some should be solved in time, some should explain the situation, and some should be persuaded and educated.

Article 27 primary party organizations such as enterprises, rural areas and communities shall pay attention to safeguarding the democratic rights of floating party members and ensuring their normal exercise.

Article 28 where a party member has real difficulties, the party organization at the primary level or the party organization at the higher level may provide appropriate assistance and encourage mutual assistance among party members so as to create conditions for the normal exercise of party members' rights.

Chapter iv liability investigation

Article 29 party organizations at all levels shall strictly implement the principles, policies and intra-party regulations concerning the protection of party members' rights, and implement the resolutions and decisions of party organizations at higher levels and party congresses at the corresponding levels concerning the protection of party members' rights. Clarifying the tasks and requirements of departments for discipline inspection and party committees at the same level, institutions directly under their direct reports, and party committees at the corresponding level in the protection of party members' rights; We will urge lower-level party organizations and leading party cadres to earnestly perform their duties in safeguarding the rights of party members, publicize guidelines, policies and intra-party laws and regulations on safeguarding the rights of party members, and educate and guide party members in correctly exercising their rights.

Article 30 the party's discipline inspection organs at all levels under the leadership of the party committee and the higher commission for discipline inspection at the same level, to do a good job of party members' rights, to accept the report about the party member rights, accusation and complaint, inspection and handling of party member rights infringement cases, the party's leading cadres and party organizations at a lower level party member rights duties of supervision and inspection.

Article 31 the party organization and publicity departments shall, in accordance with the provisions of the party constitution and other intra-party laws and regulations as well as the requirements of the party organization at a higher level, and in light of their own functions and actual work, ensure the implementation of the work of safeguarding the rights of party members. To study and resolve important issues concerning the protection of the rights of party members within the scope of their functions and duties, and put forward opinions and measures on the implementation of the protection of the rights of party members to party organizations at the same level, so as to create conditions and provide services for the normal exercise of the rights of party members.

Article 32. Leading cadres at all levels of the party shall set an example in observing and strictly implementing the provisions on the protection of the rights of party members. We should fully respect and care about the rights of party members, and attach importance to solving practical problems concerning the protection of party members' rights. We will take effective measures to ensure the rights of party members in local areas, departments and units.

Article 33 safeguarding the rights of party members is an important responsibility of party organizations and leading cadres at all levels. In case of dereliction of duty or dereliction of duty in safeguarding the rights of party members, those responsible shall be investigated for responsibility in accordance with relevant provisions.

Article 34 the handling of violations of the rights of party members is an important link in safeguarding their rights. Party organizations to which party members belong or at higher levels may order them to desist from infringing ACTS, make amends for apologies, inspect, admonish or criticize them. If the circumstances are relatively serious, party discipline punishment shall be given according to regulations.

Party organizations at higher levels should criticize and educate those responsible for violations of party members' rights. If the circumstances are serious, the person responsible shall be investigated for responsibility in accordance with the relevant provisions.

The handling methods prescribed in the first paragraph of this article may be used independently or in combination or with party disciplinary measures.

Chapter v supplementary provisions

Article 36 party committees of all provinces, autonomous regions and municipalities directly under the central government may, in accordance with these regulations and in light of the actual conditions of their respective work, formulate detailed rules for implementation and report them to the central committee for the record.

The CMC may, in accordance with these regulations and in the light of the actual situation of the Chinese people's liberation army and the Chinese people's armed police force, formulate detailed rules or supplementary provisions for implementation.

Article 37 these regulations shall be interpreted by the Organization Department of the CPC Central Committee for discipline inspection and commerce.

Article 38 these regulations shall go into effect as of the date of promulgation. The regulations on the protection of the rights of CPC members (for trial implementation) shall be repealed at the same time. (after)
