Interim regulations of the communist party of China on the election of grassroots organizations

Chapter I general provisions

Article 1 these regulations are formulated in accordance with the constitution of the communist party of China for the purpose of improving the party's democratic centralism and the intra-party election system.

Article 2 primary party organizations mentioned in these regulations refer to party committees in factories, shops, schools, government organs, streets, cooperatives, farms, townships, towns, villages and other primary units. The general branch committee, the branch committee, including the discipline inspection committee approved by the primary committee.

Article 3 when the term of office of a committee established by a primary party organization expires, new elections shall be held on schedule. Any extension or advance of the general election shall be submitted to the higher party organization for approval. The extension period generally does not exceed one year.

Article 4 committees established by primary party organizations shall be elected by party congresses. If the number of party members is more than 500, or if the party organization under its jurisdiction is scattered in the locality, a party congress may be convened for election with the approval of the party organization at the next higher level.

Article 5 full party members shall have the right to vote, stand for election and stand for election. Party members subjected to the punishment of being placed on probation within the party shall not have the right to vote, vote or stand for election during such period; Probationary party members have no right to vote or stand for election.

Article 6 the democratic rights of party members shall be respected and protected in the election, democracy shall be fully developed and the will of the electors shall be embodied. No organization or individual may in any way compel electors to elect or not to elect a person.

Chapter ii election of representatives

Article 7 deputies to the party congress shall be able to reflect the opinions of the units that elected them and represent the will of the party members.

The number of delegates is normally between 100 and 200, but not more than 300. The specific quota shall be determined by the party organization that convenes the congress in accordance with the principle that it is beneficial for party members to understand and directly participate in intra-party affairs and for discussion and decision of issues, and shall be submitted to the party organization at a higher level for approval.

The allocation of deputies shall be determined on the basis of the number of party members and the principle that deputies are extensive.

Article 8 the number of candidates for deputies shall exceed 20 percent of the number of candidates to be elected.

Article 9 candidates for deputies shall be deliberated and nominated by all the party members organized by the electoral unit, determined according to the opinions of the majority, and submitted to the party congress or the party congress for election.

Article 10. The party committee of the last term established a group to examine the qualifications of deputies, which shall be responsible for examining the selection procedures and qualifications of deputies.

If the selection of deputies does not conform to the prescribed procedures, the original electoral unit shall be instructed to conduct a new election. If a representative is not qualified, he shall be instructed to replace the unit that elected him.

The credentials group shall report to the preparatory meeting of the party congress on the status of the credentials.

Chapter iii election of committees

Article 11 candidates for members of committees established by primary party organizations. To be nominated according to the principle of having both political integrity and talent and reasonable group structure.

Article 12 the difference between candidates for committee members and those who should be elected shall be 20%.

Article 13 candidates for members of a general party branch committee or party branch committee shall be determined by the previous party committee on the basis of the opinion of the majority of party members and shall be elected at the party congress.

Article 14 the appointment of members of primary party committees and commissions for discipline inspection established upon approval:

In the event of a general meeting of party members, the party committee of the previous term shall propose candidates on the basis of the opinions of the majority of the party organizations under its jurisdiction, submit them to the next higher party organization for examination and approval, and then submit them to the general meeting for election.

Where a party congress is convened, the party committee of the previous term shall propose candidates on the basis of the opinions of the majority of the party organizations under its jurisdiction, submit them to the presidium of the congress after examination and approval by the party organization at the next higher level

After discussion and adoption, the presidium of the congress shall submit it to each delegation (group) for deliberation and discussion, determine the candidates according to the opinions of the majority of deputies, and submit it to the party congress for election.

Article 15 a party congress or a by-election at a party congress shall be held if any member of the committee becomes vacant during the term of office.

When the higher party organization deems it necessary, it may transfer or appoint the person in charge of the lower party organization.

Article 16 for the selection of a secretary or deputy secretary of a committee established by a primary party organization, candidates shall be proposed by the previous party committee and submitted to the party organization at a higher level for examination and approval before election is held at a plenary meeting of the committee members.

The election of a secretary or deputy secretary of a party branch without a committee shall be held at a general meeting of party members after all party members have fully deliberated, put forward candidates and submitted them to the party organization at a higher level for examination and approval.

Article 17 candidates for the standing committee of a primary party committee whose standing committee has been approved to be established shall be proposed by the previous party committee according to the difference of one or two more members than the number of candidates to be elected, submitted to the party organization at the next higher level for examination and approval, and elected at the plenary meeting of the party committee.

Article 18 members elected shall be reported to higher party organizations for the record. Members of the standing committee, secretaries and deputy secretaries shall be submitted to the higher party organizations for approval. The secretary or deputy secretaries elected by the commission for discipline inspection shall, after being approved by the party committee at the corresponding level, be reported to the party organization at the next higher level for approval.

Chapter iv implementation of election

Article 19 at the time of election, the number of people who have the right to vote at the meeting shall exceed four-fifths of those who shall attend the meeting. The meeting shall be valid.

Article 20. Elections shall be held at a general meeting of party members and shall be presided over by the previous party committee. A party branch without a committee is elected and presided over by the previous party branch secretary.

The presidium of the party congress shall preside over the election of the party congress. Members of the presidium of the congress shall be nominated from among the deputies by the party committee of the previous session or by each delegation (group), discussed by all the deputies, and submitted to the preparatory meeting of the congress for voting and approval.

When the standing committee, secretary and deputy secretaries are elected and the party congress is convened at its first plenary meeting, the presidium of the congress shall designate a newly elected member to preside over the meeting. When a party congress is convened, it shall be presided over by a newly elected member recommended by the previous committee.

Article 21 before the election, the party organization of the electoral unit or the presidium of the general assembly shall present the candidates' resumes, achievements, major advantages and disadvantages to the electors in a practical and realistic manner, and answer their inquiries in a responsible manner. According to the requirements of the electors, candidates can be organized to meet with the electors, and the candidates can introduce themselves and answer the questions raised by the electors.

Article 11 an election shall have a vote supervisor who shall be responsible for supervising the whole process of the election.

The supervisors elected by the general assembly or party congress shall be elected by all party members or delegates (groups) who are not candidates and shall be approved by a vote of the general assembly or party congress.

The supervisors elected by the committee shall not be elected from among the members who are candidates for the position of secretary, deputy secretary or member of the standing committee, and shall be approved by a vote of all the members.

Article 23 there shall be vote counters in an election. The tellers shall work under the supervision of the invigilators.

Article 24 all elections shall be held by secret ballot. The list of candidates on the ballot paper is in alphabetical order.

If the elector cannot write the ballot, he or she may entrust a non-candidate to write it at the will of the elector. Party members or party representatives who do not attend the meeting for any reason may not entrust others to vote on their behalf.

Article 25 an elector may vote for or against a candidate, or abstain from voting. Those who vote no may choose another.

Article 26 after the voting is over, the watcher and the meter shall check the number of votes cast and the number of votes cast, make a record, sign by the watcher and publish the number of votes cast by the candidates. The names of the elected persons shall be announced by the presiding officer of the meeting.

Article 27 the number of votes returned in an election shall be less than the number of votes cast, and the election shall be valid; If there are more than the number of voters, the election shall be invalid and a new election shall be held.

The number of votes cast in each ballot is less than the required number of votes, and more than the required number of votes are invalid.

Article 28 a candidate may not be listed as a candidate unless his affirmative vote exceeds half of the total number of people who have the right to vote.

Article 29 at the time of a formal election, the electors shall not be elected until they have received more than half of the votes in favor of them.

When there are more electors than there should be, the one with more votes is elected. If the number of votes is equal and the election cannot be determined, the electors who have equal votes shall vote again, and the one who has more votes shall be elected.

When the number of electors is less than the number to be elected, another election shall be held for the number less than the number to be elected. If the number of candidates is close to the required number, the number of candidates can be reduced and there will be no more elections.

Chapter v supervision and punishment

Article 30 these regulations shall be supervised and implemented by the higher party committees and commissions for discipline inspection.

Article 31 during an election, anyone who violates the provisions of the party constitution and these regulations must be investigated and dealt with seriously.

Chapter vi supplementary provisions

Article 32 electoral units shall, in accordance with these regulations, formulate detailed rules for election work, which shall be implemented after being discussed and adopted by the party congress or the party congress.

Article 33 the election of the primary party organizations of the Chinese people's liberation army shall be governed by the central military commission in accordance with the spirit of these regulations.

Article 34 these regulations shall be interpreted by the Organization Department of the CPC Central Committee.

Article 35 these regulations shall go into effect as of the date of promulgation. If the previous provisions and measures concerning election work of primary party organizations are inconsistent with these regulations, these regulations shall apply.
