Regulations of the communist party of China on inspection work (trial)

Chapter I general provisions

Article 1 these regulations are formulated in accordance with the constitution of the communist party of China for the purpose of strengthening intra-party supervision, improving the inspection tour system and standardizing the inspection tour work.

Article 2 the central committee of the party and the committees of provinces, autonomous regions and municipalities directly under the central government shall implement the system of inspection Tours, and establish special inspection agencies to supervise the inspection Tours of leading bodies of party organizations at lower levels and their members.

Article 3 the inspection tour shall follow the guidance of deng xiaoping theory and the important thought of three represents, thoroughly apply the scientific outlook on development, adhere to the party's principle of governing the party and strictly governing the party, maintain party discipline, and ensure the implementation of the party's line, principles and policies as well as major decisions and arrangements of the central committee.

Article 4 inspection Tours shall adhere to the party's leadership and responsibilities at different levels, seek truth from facts, be objective and fair, and carry forward the principles of democracy and reliance on the masses.

Chapter ii organizational setup

Article 5 the central committee of the party and the committees of provinces, autonomous regions and municipalities directly under the central government shall establish leading groups for inspections and shall be responsible and report on their work respectively to the central committee and the committees of provinces, autonomous regions and municipalities directly under the central government.

Article 6 an office under the leading group for inspection shall be its daily office. Its offices are set up in the party's commission for discipline inspection at the corresponding level.

Article 7 the central committee of the party and the committee of a province, autonomous region or municipality directly under the central government shall set up a inspection group to undertake the task of inspection and report to the leading group for inspection.

Article 8 inspection group shall set up group leader, deputy group leader, inspectors and other working positions. Inspection group implements the leader responsibility system, and the deputy leader assists the leader in work.

Article 9 the responsibilities of the leading group for inspection are as follows:

(1) to implement the resolutions and decisions of the central committee of the party and the committees of provinces, autonomous regions and municipalities directly under the central government on inspection Tours;

(2) to study and decide on annual and phased plans and plans for inspections;

(3) to hear reports on inspection work;

(4) to study the application of inspection results and put forward relevant opinions and Suggestions;

(5) to report to party organizations at the same level on their inspection work;

(vi) to manage and supervise inspection group;

(7) to study and deal with other important matters in inspection Tours.

Article 10 the central government shall be responsible for inspecting the leading bodies of the following party organizations and their members:

(1) party committees of provinces, autonomous regions and municipalities directly under the central government and leading groups of party members of governments at the same level;

(2) the standing committees of the people's congresses of provinces, autonomous regions and municipalities directly under the central government and the leading party members of the CPPCC committees;

(3) leading party organizations and members of other units that the central committee requires to inspect.

Article 11 the party committee of a province, autonomous region or municipality directly under the central government shall be responsible for inspecting the leading bodies of the following party organizations and their members:

(1) the party committees of cities (prefectures, prefectures and leagues), counties (cities, districts and banners) and the leading party groups of governments at the same level and their members;

(2) the standing committees of municipal (prefectural, prefectural and league), county (municipal, district and banner) people's congresses and leading party groups of CPPCC committees and their members;

(3) leading party organizations and members of other units that the party committee of a province, autonomous region or municipality directly under the central government requests to inspect.

Article 12 the inspection group shall supervise the leading bodies of party organizations and their members listed in article 10 and article 11 of these regulations as follows:

1) the implementation of the party's line, principles, policies, resolutions and decisions, especially the implementation of deng xiaoping theory, the important thought of three represents and the scientific outlook on development;

(2) the implementation of democratic centralism;

(3) the implementation of the responsibility system for building a clean and honest party conduct and diligent administration;

(4) progress in improving work style;

(5) selection and appointment of cadres;

(6) other matters requested by the party organization that sent the inspection group.

Article 13 the functions and duties of the leading group office for inspection are as follows:

(1) to undertake comprehensive coordination, policy research and institutional development;

(ii) report to the leading group for inspection work the important situation in the inspection work, and convey to the inspection group the decision and deployment made by the leading group for inspection work;

(3) cooperate with relevant departments in training, assessment, deployment, appointment and removal, supervision and management of patrol personnel;

(iv) cooperate with inspection group to supervise the matters decided by the leading group of party organization and inspection work dispatched by inspection group;

(5) to handle other matters assigned by the leading group for inspection.

Chapter iii working procedures

Article 14 party committees of provinces, autonomous regions and municipalities directly under the central government, municipal (prefectural, prefectural and league) party committees, standing committees of people's congresses, governments and leading groups of the CPPCC committees at the same level and their members shall be inspected once or twice in each term of office.

Inspection of party committees of counties (cities, districts and banners), standing committees of people's congresses, governments and leading groups of CPPCC committees at the same level and their members shall be determined by party committees of provinces, autonomous regions and municipalities directly under the central government.

Article 15 before the inspection group carries out the inspection, it shall ask the discipline inspection and supervision organ, organization, personnel, audit, petition and other departments at the same level for information about the leading group of the party organization and its members of the inspected areas and units.

Article 16 the inspection group shall, according to the situation of the areas and units inspected, formulate the patrol work plan and report it to the leading group office of the patrol work for the record. Article 17 the office of leading group of inspection work shall inform the inspected areas and units in writing of the arrangement of inspection work 10 working days in advance, and coordinate and arrange the entry of inspection group into relevant matters.

Article 18 after inspection group enters the patrol area or unit, it shall notify the leading group of the party organization and its members of the plan, arrangement and requirements for the patrol, and explain the purpose and tasks of the patrol.

Article 19 inspections shall be carried out by party organizations of the areas and units being inspected. The areas inspected shall publish the supervision scope, time arrangement and contact information of the inspection work through the major local news media.

The units inspected shall publicize the above-mentioned situation through internal circulars and other means.

Article 20 the main working mode of inspection group is as follows:

(1) to hear the work reports of the party committees (party leading groups) of the areas and units inspected and the special reports of the relevant departments;

(2) to attend, as required by work, the relevant meetings of the areas and units being inspected, the democratic life meetings of the leading bodies of the party organizations being inspected and the reports on their work;

(3) to accept letters, telephone calls and visits reflecting the problems of the leading bodies of party organizations and their members being inspected;

(4) to convene a symposium to hear opinions;

(5) having individual conversations with members of the leading bodies of party organizations and other cadres and masses being inspected;

(6) to read and copy relevant documents, archives, meeting minutes and other materials;

(7) democratic assessment and questionnaire survey of the leading bodies of party organizations and their members inspected;

(8) to conduct visits and investigations in an appropriate manner to the subordinate units or departments of the inspected areas or units;

(9) with respect to the understanding of relatively strong professional or especially important issues, the relevant functional departments or professional organizations may be consulted for assistance.

Article 21 in case of any of the following circumstances during the inspection, inspection group shall timely report to the leading group for inspection:

(1) members of leading bodies of party organizations and other cadres under the management of the party committees of central or provincial, autonomous region or municipality directly under the central government who are suspected of serious violations of discipline and law;

(2) violations of the principle of democratic centralism by the principal party and government leaders of the areas or units under inspection, which seriously affect work and the construction of leading bodies;

(3) major issues that concern the immediate interests of the people, reflect strongly on them by cadres and the masses, and affect the overall situation of reform, development and stability;

(4) other matters that the inspection group considers to be timely reported.

Below special circumstance, inspection group can report to the party organization that sends inspection group directly main leader comrade inspects a circumstance above.

Article 22 in the course of inspection, if it is found that there are problems in the areas or units under inspection that are strongly reported by the masses, clearly violate regulations and can be solved in a timely manner, the inspection group shall, after obtaining the consent of the party organization that sent it, put forward Suggestions on handling the problems to the party organization under inspection or its main responsible person in a timely manner.

Article 23 after the inspection and understanding work is finished, inspection group shall write the inspection report, report the inspection to the leading group of the inspection work, and put forward Suggestions for handling the important information and problems that are understood and mastered.

Article 24 the leading group of inspection work shall, according to the Suggestions of inspection group, study and put forward handling opinions, and report to the party organization that sent inspection group for decision.

Special reports shall be prepared and submitted to the party organization that sent the inspection group on major issues that affect economic and social development and party building, or on major policy adjustments and institutional reform.

Article 25 after the inspection report is approved by the inspection work leading group, inspection group shall feed back the situation and problems understood during the inspection to the inspected area and unit party organization leading group within 15 working days, and put forward improvement Suggestions pertinently.

Article 26 the inspected areas and units shall submit the rectification plan to the leading group of inspection work through the office of leading group of inspection work within 60 working days after receiving the feedback from inspection group, and submit the rectification report within 12 months after the submission of the rectification plan.

The office of the leading group for inspections shall timely inform the functional departments concerned of the rectification of the areas and units inspected.

Except for special circumstances, the inspected areas and units shall publish the rectification within a certain scope.

Article 27 matters decided by the party organizations dispatched by inspection group shall be transferred to and handled according to the principles of the authority of management of cadres, centralized management and respective functions in the following ways:

(1) to transfer to the party organization inspected for handling such matters as the execution of the party's line, principles and policies, the implementation of the scientific outlook on development, the responsibility system for the building of party conduct and clean government, and the handling of reform, development and stability;

(2) to hand over to the disciplinary inspection and supervision organ for handling the problems of the party organization leaders and their members suspected of violating discipline;

(3) to the inspection party organization leading group and its members in the implementation of democratic centralism, cadre selection and appointment, work style and other aspects of the existing problems and inspection group put forward on the construction of leading group, transferred to the organization personnel department to deal with.

Article 28 after receiving the matters handed over by the leading group office for inspection, the relevant party organizations, organs and departments shall handle them in accordance with the prescribed time limit and give written feedback to the office of the leading group for inspection.

Article 29 entrusted by the discipline inspection organ or organizational department dispatched by the party organization, the leader or deputy leader of the inspection group may, in accordance with relevant regulations, admonish and admonish members of the leading group of the party organization inspected.

Article 30 the inspection group shall understand the rectification situation of the inspected areas and units and report to the leading group of the inspection work by means of return visit.

Article 31 disciplinary inspection authorities and personnel departments shall take the results of inspections and the rectification of inspections as important basis for the assessment, selection and appointment of cadres, awards and punishments, and the adjustment, removal and demotion of cadres.

Chapter iv personnel management

Article 32 patrol personnel shall meet the following basic requirements:

1. Being politically firm, maintaining a high degree of unity with the central committee of the party, earnestly studying marxism-leninism, MAO zedong thought, deng xiaoping theory and the important thought of three represents, thoroughly applying the scientific outlook on development, resolutely carrying out the party's line, principles and policies, and having the necessary level of political theory to perform one's duties;

(2) adhere to principles, act in accordance with the law, seek truth from facts, be fair and upright, keep in touch with the masses, be honest and clean, have a strong sense of discipline and strictly observe the secrets of the party;

(3) have a strong sense of professionalism and responsibility, a keen mind, certain work experience, and be familiar with party affairs, government affairs and policies and regulations;

(4) strong research and writing ability;

(5) to be physically fit and competent for the job.

Article 33 inspection personnel may be selected and assigned by means of organization, public selection, competition and unit recommendation.

Patrol personnel shall exchange posts in rotation according to regulations.

Personnel not suitable for patrol work shall be adjusted in time.

Article 34 inspection personnel shall exercise official, office-holding and geographical withdrawal.

Article 35 party organizations shall be established in the leading group office of inspection and the inspection group to educate, manage, supervise and provide services to their party members, strictly enforce the party's organizational activities, and conduct criticism and self-criticism.

Article 36 the office of leading group of inspection work and inspection group shall strengthen their own construction, establish and perfect the daily management system, strictly regulate the working procedures, organize and carry out study and training, and constantly improve the political and professional quality and working level of the inspection workers.

Article 37 personnel engaged in inspections who have made outstanding achievements in their inspections and have made important contributions to safeguarding the interests of the party and the state shall be commended and rewarded.

Chapter v discipline and responsibility

Article 38 party organizations dispatched by inspection group shall strengthen the leadership of the inspection tour and promptly solve the major problems encountered in the inspection tour.

Article 39 the leading group of the party organization and its members who are inspected shall consciously accept the inspection and supervision and actively cooperate with inspection group in their work.

Party members are obliged to report the situation to the inspection group truthfully.

Article 40 the inspection group shall strictly implement the system of requesting instructions and reporting, and shall timely request instructions and report on important situations and major issues in the inspection tour.

Article 41 if the inspection group neglects its duty, should have known but failed to do so, and should have reported but failed to do so, the person responsible shall be investigated for disciplinary responsibility in accordance with relevant regulations.

Article 42 in any of the following cases, the patrol personnel shall be ordered to make a written inspection, circulate a notice of criticism, or be adjusted, removed or demoted. If the violation of discipline is constituted, disciplinary action shall be taken in accordance with relevant provisions; If a crime is suspected, it shall be transferred to a judicial organ for handling according to law:

(1) making use of the convenience of inspection to seek personal gains or seeking illegitimate interests for the entruster;

(2) concealing, distorting or fabricating facts;

(3) divulging or spreading secrets of inspection Tours;

(4) committing other ACTS in violation of the discipline of patrol work.

Article 43 in any of the following circumstances, the principal leaders of the leading bodies of the areas or units being inspected and other persons directly responsible shall be ordered to make a written inspection, circulate a notice of criticism, or to adjust, remove or lower their posts. If the violation of discipline is constituted, disciplinary action shall be taken in accordance with relevant provisions; If a crime is suspected, it shall be transferred to a judicial organ for handling according to law:

(1) conceal, fail to report or intentionally provide false information to inspection group;

(ii) refuse or fail to provide relevant documents and materials to inspection group as required;

(3) refusing to correct the existing problems without justified reasons or making rectification as required;

(4) hinting, instructing or compelling the units or personnel concerned to interfere with or obstruct the inspection tour;

(5) other ACTS that interfere with the patrol work.

Article 44 if the cadres and masses of the areas and units being inspected find that the patrol personnel have violated the ACTS listed in article 42 of these regulations, they shall have the right to report to the office of the leading group for patrol work or to the leading group for patrol work, or to report directly to the relevant departments and organizations in accordance with the relevant provisions.

Chapter vi supplementary provisions

Article 45 the central commission for discipline inspection and the Organization Department of the CPC Central Committee may, in accordance with these regulations, formulate detailed rules for implementation or individual provisions.

Article 46 party committees of all provinces, autonomous regions and municipalities directly under the central government may, in accordance with these regulations and in the light of their respective realities, formulate regulations for implementation and submit them to the central commission for discipline inspection and the central organization department for the record.

Article 47. The central military commission shall, with reference to these regulations, formulate regulations on inspection Tours conducted by party organizations of the Chinese people's liberation army and the Chinese people's armed police forces.

Article 48 these regulations shall be interpreted by the Organization Department of the CPC Central Committee for discipline inspection and commerce.

Article 49 these regulations shall go into effect as of the date of promulgation.
